By accessing or using the website at sanleandroheavydutytowing.com, or by requesting or receiving services from Speedy San Leandro Heavy Duty Towing ("we," "us," or "our"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our website or services.
These Terms apply to all visitors, customers, and others who access our website or use our services. We may update these Terms at any time by posting a revised version at this URL. Continued use of our website or services after changes are posted constitutes your acceptance of the updated Terms.
Speedy San Leandro Heavy Duty Towing provides towing, vehicle recovery, and roadside assistance services in San Leandro, California, and surrounding communities in the East Bay area. Our services include, but are not limited to, heavy duty towing, accident recovery, flatbed towing, commercial towing, emergency towing, winch-out service, and roadside assistance.
Service availability depends on equipment availability, location, and conditions at the time of the request. We reserve the right to decline a service request if we determine that the job is outside our capabilities or cannot be safely completed.
We operate 24 hours a day, 7 days a week. Response times vary depending on call volume, traffic conditions, and the location and complexity of the service requested.
Any estimate provided before or during a service call is an approximation based on the information available at that time. Final pricing is determined by the actual work performed, the equipment used, mileage, time, and any complications that arise on scene.
We will make reasonable efforts to inform you of any material changes to the estimated cost before proceeding with work that significantly exceeds the estimate. However, emergency situations may require immediate action before a revised estimate can be provided.
Towing rates in California are subject to state and local regulation. For tows ordered by law enforcement, applicable regulatory rate schedules may govern what is charged. You have the right to request a written itemized invoice for all services. Always review your invoice before paying.
Scheduled non-emergency service appointments are confirmed by phone or email. We ask that you provide at least 4 hours notice if you need to cancel or reschedule a planned appointment. Late cancellations or no-shows may result in a cancellation fee.
For emergency calls, we dispatch as quickly as possible based on available resources. We are not liable for delays caused by traffic, weather, road closures, or other conditions outside our control.
We reserve the right to cancel or reschedule a service appointment if conditions at the job site are unsafe or if appropriate equipment is unavailable. In such cases, we will notify you as promptly as possible.
Payment is due at the time services are completed unless a prior billing arrangement has been established. We accept payment by cash, major credit cards, and other methods as noted at the time of service.
Accounts with outstanding balances may be subject to late fees. We reserve the right to pursue collection of unpaid amounts through appropriate legal channels. You are responsible for any collection costs, including reasonable legal fees, incurred to collect an overdue balance.
If your vehicle is in our storage facility, storage fees begin accruing upon the vehicle's arrival at the yard. Storage rates are subject to applicable California regulations. Retrieval of your vehicle requires payment of all outstanding towing and storage charges, plus presentation of valid identification and proof of ownership or authorization.
You are responsible for providing accurate information about the location, type, and condition of your vehicle when requesting service. Providing inaccurate or incomplete information may result in delays, the wrong equipment being dispatched, or an inability to complete the service.
You are responsible for removing all personal belongings from your vehicle before it is towed. We are not responsible for personal items left in a vehicle during towing or while the vehicle is in storage.
You must have the legal right to authorize service on a vehicle - either as the registered owner or as an authorized representative of the owner. We reserve the right to require proof of ownership or authorization before releasing a vehicle.
To the fullest extent permitted by law, Speedy San Leandro Heavy Duty Towing shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to our services or your use of our website, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising from our services shall not exceed the amount you paid us for the specific service giving rise to the claim. This limitation applies regardless of the theory of liability - whether in contract, tort, negligence, or otherwise.
We are not responsible for pre-existing damage to a vehicle, damage caused by the condition of the vehicle itself, or damage resulting from your failure to disclose relevant information about the vehicle at the time of the service request.
Our website and the information on it are provided "as is" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
We make no warranties regarding the accuracy, completeness, or timeliness of any information on our website. Service descriptions are for general informational purposes only and are not a guarantee that any particular service will be available or suitable for your situation.
You agree to indemnify, defend, and hold harmless Speedy San Leandro Heavy Duty Towing and its owners, employees, contractors, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of your use of our website or services, your violation of these Terms, or your violation of any applicable law.
If you have a complaint or dispute regarding our services, please contact us directly first. We will make a good-faith effort to resolve the issue through informal discussion.
If the dispute cannot be resolved informally, both parties agree to submit the matter to binding arbitration in San Leandro, California, under the rules of the American Arbitration Association (AAA), before pursuing any court action. The arbitrator's decision will be final and binding, and judgment may be entered in any court of competent jurisdiction.
Notwithstanding the above, either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent immediate or ongoing harm.
These Terms and Conditions are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes not subject to the arbitration provision above shall be brought exclusively in the state or federal courts located in Alameda County, California.
